Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the SCULPTRO website (sculptro.app), user accounts, cloud services, and the SCULPTRO desktop application and audio plugins (macOS & Windows) operated by Javor Vatchkov / SCULPTRO.

Summary for Musicians (Plain English)
  • 100% Royalty-Free Audio Ownership: You retain full commercial rights to the WAV audio samples you sculpt, refine, and export in SCULPTRO.
  • No Hostage Samples: If your 14-day evaluation trial expires, your existing library, project history, and DSP finishing strip remain playable and exportable forever.
  • Transparent Lifetime Licensing: A Sculptro Full Lifetime license key (SCULP-XXXX-XXXX-XXXX) is a one-time purchase with no recurring subscription required for local synthesis.

1. Acceptance of Terms

By registering a SCULPTRO account, downloading or launching the SCULPTRO desktop application, or purchasing a license key, you confirm that you have read, understood, and accepted these Terms & Conditions, our Privacy Policy, and our EU Cookie Policy. When you create an account, we record the exact timestamp and version of the Terms you accepted.

2. Account Registration & 14-Day Free Trial

To start a 14-day Sculptro Full evaluation trial or activate a license key, you must register with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials.

New accounts receive a 14-day evaluation period granting full access to sound generation and acoustic morphing. Once the 14-day trial expires, creating or morphing new AI samples requires an active SCULPTRO license key; however, all previously generated audio files, snapshots, and the real-time DSP finishing strip remain accessible in Free/Playback mode.

3. Software License & Early Access Staircase

Upon purchasing a SCULPTRO license (processed via our Merchant of Record, Polar.sh, or issued directly), you are granted a personal, non-exclusive, non-transferable, perpetual license to install and use the SCULPTRO software for your own music creation, production, and sound design work.

Early Access Sculptro Full licenses include 12 months of software updates at no additional software license fee. You may not redistribute, resell, rent, decompile, reverse-engineer, or share your license key publicly.

4. Audio Output & Intellectual Property

SCULPTRO claims zero ownership or royalties over the audio samples, stems, loops, or musical works you generate, morph, or process using the application. Subject to the underlying model terms (such as Stability AI Stable Audio terms when using local weights or Cloud APIs), you are free to use your exported WAV files in commercial releases, live performances, sync licensing, and sample packs.

The SCULPTRO application, Spider Diagram interface, DSP algorithms, visual design, brand assets, and source code remain the exclusive intellectual property of Javor Vatchkov / SCULPTRO.

5. Local Neural Models, BYOK & Cloud AI Credits

SCULPTRO supports both local on-device Stable Audio 3 inference (macOS & Windows) and optional Cloud AI providers (including Stability AI, ElevenLabs, OpenAI, Anthropic, Google Gemini, OpenRouter, and SCULPTRO Managed AI Credit keys).

  • Bring Your Own Key (BYOK): When you configure your own third-party API keys in SCULPTRO, those keys are stored locally on your device and requests are sent directly to the respective provider under your account with that provider.
  • Managed Chat AI Credits: Prepaid AI credit top-up codes (SCULPAI-...) provide metered access to cloud LLM co-pilot models until the USD credit balance is depleted. Unused promotional credits have no cash redemption value.

6. Acceptable Use

You agree not to misuse SCULPTRO or its APIs, including attempting unauthorized access to our servers, automated scraping, abusing trial provisioning, or using the software to infringe third-party copyrights or voice/likeness rights.

7. Account Termination & Personal Data Erasure

You may delete your account and all associated personal data at any time through the Account / Settings modal on our website or inside the SCULPTRO desktop app, or via our Privacy & Data Deletion page. Please note that deleting your account permanently removes your cloud license association and AI credit ledger from our database, though any WAV files saved locally in ~/Music/Sculptro/ on your computer remain untouched.

8. Disclaimer of Warranties & Limitation of Liability

SCULPTRO is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable EU and Dutch law, Javor Vatchkov / SCULPTRO shall not be liable for any indirect, incidental, consequential, or special damages, or for any loss of studio data, profits, or business interruption arising out of the use or inability to use the software. Total aggregate liability shall not exceed the amount you paid for your SCULPTRO license in the preceding twelve (12) months.

9. Governing Law & Contact

These Terms are governed by the laws of the Netherlands and applicable European Union regulations, without regard to conflict of law principles. Mandatory consumer protection rights in your EU country of residence remain unaffected.
